Terms Of Service

By accessing or using Rooted Sessions, you agree to these terms. If you do not agree, do not use the service. Our Privacy Policy explains how we collect, use and retain personal information. If you use the service on behalf of a business, you must have authority to act for that business.

Your agreement for use of this software is with Root & Return Co doing business as Rooted Sessions. When you book a session, your photography agreement is between you and your photographer — they set the pricing, the coverage, the deliverables and the cancellation terms. Rooted Sessions is not a party to that agreement and does not photograph sessions.

You need an account to run a studio or use account-only client features; some shared pages can be viewed without an account. Keep your login details private and give us accurate information — contracts, invoices and reminders all rely on it. Client accounts and photographer accounts are separate; one email belongs to one side.

You must be at least 18 to create an account, or have a parent or guardian book on your behalf.

You are responsible for activity you authorize through your account. Let us know promptly if you suspect someone has accessed it without permission.

Photographer plans are billed monthly or yearly after a 7-day free trial. Your plan renews automatically until you cancel, and you can cancel anytime from Studio → Billing. Cancelling stops future charges and keeps your access through the end of the period you've already paid for.

A payment card is required for the trial. Your selected price and billing interval are shown before you subscribe. Unless you cancel before the trial ends, your paid subscription starts when the trial ends. Plan features and storage allowances depend on the plan you select.

If we ever raise prices, existing subscribers stay on the rate they signed up at. Price changes only apply to new subscriptions.

Session payments — deposits, payment plans and balances — are collected by your photographer through their own connected payment account. Rooted Sessions passes the payment through and does not hold your money. Refunds and payment disputes for a session are handled by the photographer.

Photographers who connect their own Quo number can send client text messages through Rooted Sessions. Photographers are responsible for obtaining any required consent before texting and for respecting opt-outs. Providing a phone number alone does not grant permission for marketing messages.

Text messages are for session communication only, not marketing. Message frequency varies, and message and data rates may apply from your carrier. You can opt out at any time by replying STOP to any message, or contact your photographer for help. Opting out stops the texts but doesn't affect your booking itself. Messages are sent from the photographer's connected Quo number; Quo and your carrier also have their own terms.

You retain ownership of the content you own and upload, including photographs, videos, contract text, questionnaires and planning information. You grant us a limited, non-exclusive license to store, process, format, display and deliver that content only as needed to provide the service according to your choices — for example, displaying an opted-in portfolio, delivering a gallery or sending a contract to your client. This does not transfer ownership of your photographs to us.

Don't upload anything you don't have the rights to, and don't upload anything unlawful, harassing or explicit involving minors. We can remove content and close accounts that break this.

You are responsible for having the rights and permissions to upload and share photographs, videos, documents and information about other people, including any required releases or consent. Only feature work publicly when you have the right to do so.

Gallery links and other client links should be treated as confidential. A recipient may forward a link, and anyone with it may be able to open the shared content, subject to the access controls you have enabled. Choose recipients and gallery access, download and expiry settings carefully. A gallery's viewing expiry is separate from permanent deletion of its files.

Keep independent copies of your originals and important business records. Rooted Sessions is not a separate backup or archival service. The subscription-lapse retention and explicit account-deletion periods below apply to retained account content; they do not guarantee uninterrupted gallery access or recovery of files you intentionally delete separately.

When you share a session, proposal, gallery or planning document, you are responsible for deciding who should receive it and ensuring you have permission to share the information it contains. Clients and other recipients must respect the photographer's usage rights and the privacy of others. Sharing a gallery does not, by itself, transfer copyright or grant commercial use rights.

Optional AI-assisted tools can extract information from documents or help draft content. Information you submit to those tools is processed as described in our Privacy Policy. Only submit material you have permission to use and share for that purpose.

AI output can contain mistakes or omissions. Review extracted details and drafts before approving, saving or sending them. These tools do not replace legal, financial or other professional advice; you remain responsible for the contracts, prices and communications you approve.

Don't attempt to break, scrape, overload or reverse-engineer the service, access other people's accounts, or use Rooted Sessions to send spam. Do not upload malicious software, distribute unlawful content, infringe others' rights or bypass access and storage restrictions. These restrictions apply to the extent permitted by law.

We work to keep Rooted Sessions running, but the service is provided as-is without guarantees of uninterrupted availability. We may add, change or retire features over time. If a change materially affects a paid plan, we'll let subscribers know by email.

Keep independent copies of essential timelines, contacts and documents for time-sensitive sessions. Payment processing, text delivery and other connected services also depend on third-party providers and may be affected by their availability and terms.

You can request account deletion in Account Settings. Your account and shared photographer pages are hidden, and you have 30 days to sign in and restore it. After the recovery window, permanent cleanup removes your uploaded files and removable account records. Cleanup runs daily, with additional runs where necessary. Restoring an account does not restart a cancelled subscription. Provider-held records and information legally required to be retained are subject to the exceptions described in our Privacy Policy.

Payment trouble or subscription cancellation alone does not authorize account deletion. We keep your existing photographs, videos, and studio records for at least 12 months after paid access ends. Shared galleries remain viewable and downloadable for at least 90 days after paid access ends, subject to your publication, password, expiry and download settings. Account records and gallery originals remain exportable from Account Settings without a paid subscription, including archived or expired galleries whose files remain stored. This does not provide continued access to other paid features or a separate backup service.

We do not automatically delete retained files when these minimum periods end. Before platform-initiated photograph removal after the protection period, we will email you at least 30 days in advance. This does not postpone your own explicit deletion request or override legally required removal of unlawful material. An explicit account deletion request takes precedence and uses its separate 30-day recovery window; restore the account during that window if you need to export its content.

We can suspend or close an account that breaks these terms or creates risk for other users. If we close your paid account without cause, we'll refund the unused part of your current billing period.

To the extent the law allows, Rooted Sessions isn't liable for indirect or consequential losses, and our total liability for any claim is limited to what you paid us in the twelve months before the claim.

Nothing in these terms excludes rights or remedies that cannot legally be excluded, or limits liability where the law does not allow it.

If we update these terms, we'll change the date at the top of this page, and we'll email account holders about anything significant.
